Italian faces five and a half years in prison for sexual assault in Tenerife nightclub

In an upcoming trial scheduled at the Provincial Court of Tenerife for next week, an Italian man is facing serious legal ramifications, as the Prosecutor's Office has asked for a five-and-a-half-year prison sentence along with a fine of 7,500 euros after he was accused of inappropriate touching of women at a nightclub in Adeje, in the south of Tenerife.

According to the prosecution, the defendant is accused of engaging in explicit conduct, including inserting his finger under the clothes of one of the two affected women, on at least four separate occasions during the incident.

The Public Ministry is urging the imposition of additional measures, including a three-year prohibition on approaching the first victim within a 500-metre radius or communicating with her through any means. Furthermore, the accused would be mandated to participate in sexual education training programs.

In the second case, supervised release is also proposed, spanning six years, during which the accused must maintain a 500-metre distance from the second woman and refrain from any form of communication with her.

Regarding civil liability, it has been stipulated that the two complainants are entitled to compensation for the moral damages caused, along with the respective interests, as determined in the sentence execution.

To ensure the fulfilment of these compensation amounts, the Prosecutor's Office is advocating for the initiation of a separate legal proceeding.

Given that the alleged incidents occurred prior to the enactment of the "Only yes means yes" law, the charges are classified as abuse rather than aggression, as would be the case if the events had taken place after September of last year.
