Tenerife woman loses compensation payments from divorce after finding new partner

A court in Santa Cruz de Tenerife has officially annulled a €750 a month compensatory pension awarded to a woman following her separation by divorce in 2010, after it was proven she had been living with a new partner.
The ruling came from Court No. 2 for Violence Against Women, which found that living with a new partner was a valid legal reason to end the pension payments.
The original agreement was made in July 2010 as part of a mutually agreed separation. However, in April 2024, a new legal process began, initiated by the ex-husband, seeking a final divorce and an update to the original terms, specifically, the cancellation of the payments.
Although the woman denied living with a new partner, the court was provided with extensive evidence to the contrary. The ruling pointed to a stable, long-term relationship that disqualified her from continuing to receive the monthly payments.
The case was largely supported by a detailed report from a private investigation agency, which documented the woman's relationship between September 2023 and March 2024. Evidence included overnight stays, shared outings, and the man’s frequent presence at her place of residence.
Neighbours also confirmed regular joint activities, including shopping trips, restaurant visits, and the use of a shared car. Mail addressed to the woman at the man’s home further supported claims of shared living.
Additional evidence included invoices and receipts for construction materials, along with photographs of renovation work at the couple’s shared home. A key witness, the woman’s former son-in-law, also testified that the relationship had been ongoing since at least 2012, reinforcing claims of a long-standing and stable union.
Judge Luz Alicia Casañas Cabrera, who presided over the case, referenced updated rulings from Spain’s Supreme Court, which recognise that a stable new relationship can justifiably end a compensatory pension previously granted during separation.
Alongside granting the divorce and cancelling the pension, the court also ordered the woman to cover legal costs after rejecting her defence.
