Government to extend moratorium on evictions and rents for three months

The Central Government is extending the moratorium on evictions without alternative housing, and the full or partial reduction in rents by large property holders, and the mechanisms for the forgiveness and extraordinary extension of rental contracts, for three more months.

This has been announced this morning before today’s Congress session by the Prime Minister, Pedro Sánchez, who has gone to the Chamber to report the current state of alarm in the face of the health emergency, due to the Covid-19 pandemic, and to present the Government’s Recovery Plan.

These measures, approved by the Government to combat the economic consequences of the crisis caused by the pandemic, were due to finish at the end of the state of alarm on May 9th, so they are now extended until August, for three more months.

Sánchez said that this extension of social protection measures reaches the suspension of evictions of tenants without a housing alternative, including those homes without a contract when there are dependents.

Likewise, the moratorium or partial reduction of the rent will also be extended when the owner owns a large number of properties or is a public entity, and the contracts that can benefit from the extraordinary extension for six more months of the rentals under the same conditions of the current contract.

The housing rental contracts that can benefit from the extraordinary extension of six months are also extended for a further three months, under the same terms and conditions of the contract in force, “provided that a different agreement has not been reached between the part and that the owner, a natural person, had not communicated the need for the home itself”.

Finally, it includes the extension for three more months of the protection measures that were approved for those vulnerable households that face eviction procedures from their habitual residence, with the coordinated action of the judicial bodies and the competent social services, including those households affected by procedures for the release of their habitual residence, which are not derived from rental contracts, when there are dependents, victims of violence against women or minors in charge.

In this case, the possibility is established that the judge, after a weighted and proportional assessment of the specific case, has the power to suspend the eviction, when the owners of these properties are natural or legal persons who own more than 10 homes, requesting a report to the competent social services so that they can assess the situation of economic vulnerability and identify the measures to be applied to respond to said situation.
