Orange ordered to pay compensation to former customer for harassment

The Las Palmas courts have ruled that telephone company Orange, must pay 900 euros compensation to a former customer for the moral damages they have caused him, by harassing him with calls, messages and improper charges after he terminated his phone contract.

The ruling, issued by the Gran Canarian court on October 17th, is part of an arbitration award provided by the injured party, after he proved that he had cancelled his mobile phone contract in December 2019 and had returned the relevant phones to an Orange office.

However, Orange tried to charge penalties for non-compliance and consumption that were not due, according to the chronology of the events, and ‘bombarded’ him with calls and messages to claim the money, even though he explained that he had cancelled the contract.

The judicial authority ruled that the plaintiff endured "repeated pressure from the telephone company” which repeatedly sent undue invoices and threatened legal action.

The magistrate said it was clear that the contract had been cancelled by the defendant, and that he was affected by harassment for the unjustified debt and threats if he didn’t pay. “These actions represent a ‘personal attack’ that can be indemnified”, he said.

Orange refused to comment regarding the case.
