Timeshare compensation claims still booming during pandemic

At a time when many businesses are slumping due to the worldwide pandemic, one is still going from strength to strength – Spanish timeshare legal claims. The whole industry started to boom in 2015 following the first Spanish Supreme Court ruling against an illegal timeshare contract. This victory was achieved by Canarian lawyer Miguel Rodriguez Ceballos, and it has opened the floodgates to more compensation claims through the lower courts.

"My client had signed a contract with the Anfi Group in perpetuity but couldn’t get out of it after maintenance fees started to increase,” explains Ceballos. “It took six years, but eventually the Supreme Court ruled that the original life-long agreement was null and void.”

“I don´t think I am exaggerating when I say there could be up to 30,000 contracts that could be affected by this ruling,” he says. Since the landmark case, Ceballos’ expertise has been in high demand. For the past year he has been working as Head Lawyer at The Nordic Consulting, a Tenerife-based legal consultancy company which has been holding Europe’s largest timeshare companies to account since 2018.

It’s a good match, as the company has taken on more than 550 disputes from clients across the continent to put through the Spanish courts. Many of these clients are indeed Nordic, but the multilingual team deals with complainants from all over Europe, and translates court documents into English, Swedish, Norwegian and more than 10 other languages.

For Ceballos, the move came down to trust. “I had heard about The Nordic Consulting through a former colleague. It sounded like the company is trying to do the right thing for its clients and that gave me confidence.”

The harsh economic conditions and restrictions on travel caused by the pandemic mean that many timeshare owners have not been able to use the holidays they have paid for. It is the perfect time for them to seek advice regarding their memberships and ownerships. 

In an industry plagued by bogus companies it is imperative that they seek good advice from lawyers that have an excellent track record. The Nordic Consulting’s clients are now looking at just two to three years to extract themselves from costly contracts, and according to Ceballos´s prediction, there could be tens of thousands of timeshare owners who could soon be seriously back in pocket.
