Supreme Court to decide if Guardia Civil officer can also work as professional DJ

Spain’s Supreme Court is set to decide whether a Guardia Civil officer in Lanzarote can legally work as a DJ in his spare time, in a case that could have wider implications for police across the country.
The officer first applied for permission in May 2024, and a year later, a Madrid court ruled in his favour, allowing him to take on the second job as long as it did not interfere with his duties or working hours.
However, the State has now challenged that decision, taking the case to the Supreme Court, which will make the final ruling.
At the centre of the dispute is how additional pay received by officers should be calculated under Spain’s incompatibility laws, which regulate whether public servants can take on private work.
Current legislation allows officers to have secondary jobs, provided that any salary supplements do not exceed 30% of their basic pay. The main question is whether a specific allowance introduced to bring police wages in line with regional forces should be included in that calculation.
The earlier ruling overturned a decision by the Ministry of the Interior, which had rejected the officer’s request on the grounds that his allowances exceeded the legal limit.
The Supreme Court’s decision is expected to set a legal precedent, potentially affecting not only Guardia Civil officers but also the National Police across Spain.
