Two-year prison sentence for sexual assault of holidaymaker in Los Cristianos

A man has been sentenced to two years in prison for sexually assaulting a tourist in Los Cristianos, in the south of Tenerife. The High Court of Justice of the Canary Islands (TSJC) has upheld the original ruling issued by the Sixth Section of the Provincial Court of Santa Cruz de Tenerife, confirming the conviction following the incident.
According to the court ruling, the man, who worked as a waiter at the bar visited by the victim, took advantage of the tourist while she was intoxicated after consuming alcohol during the night.
The events occurred on 23rd October 2023, when the victim and a friend visited a bar located in the San Telmo area of Los Cristianos, where the defendant was employed.
In the early hours of the morning, the two women accepted an invitation from the bar’s owner to continue socialising and drinking at an apartment.
Later, the victim, feeling tired after drinking, lay down on a sofa in the living room and became drowsy. At that point, the defendant carried out sexual acts without her consent, taking advantage of her intoxicated state.
The court ruling states that sexual penetration was not proven, but concluded that the accused acted with sexual intent while the victim was unable to give valid consent.
In addition to the two-year prison sentence, the court ordered the defendant to pay €2,000 in compensation to the victim for the harm suffered.
