61-year-old man ordered to pay €50,000 for impregnating his teenage niece

The Supreme Court has increased the compensation a 61-year-old man in Tenerife must pay to his teenage niece after he impregnated her, from €10,000 to €50,000.

The court has upheld the six-year prison sentence and the €1,045 cost of the abortion in addition to the fine.

The family contested the initial compensation amount, deciding to make an appeal to the Supreme Court. The court agreed with the family, finding the original sum insufficiently justified.

Medical evidence highlighted the severe psychological impact on the young girl, who also has disabilities, manifesting as anxiety and depression exacerbated by the incident and the legal proceedings.

The ruling details the profound humiliation, helplessness, and distrust experienced by the minor after being violated by her uncle. The Supreme Court sided with the family and challenged the previously set compensation amount, despite legal constraints on altering such figures within different judicial tiers.

The incident occurred in late 2019 when the victim was 17 and recognised as having a 50% physical and sensory disability, with a normal IQ but borderline intelligence.

The uncle, exploiting his access, entered her bedroom on at least two occasions, engaging in unprotected intercourse, resulting in the pregnancy, which was discovered two months later, leading to an abortion.
